Terms of Service

By accessing or using the services provided by ClutchVPS, you agree to the following Terms of Service. Please read these terms carefully. If you do not agree with any part of these terms, you must immediately discontinue the use of our services.

1. Usage of Services

ClutchVPS provides hosting services for various types of servers. By using our services, you agree to the following:

  • Services may not be used to create, distribute, or host malicious content, including but not limited to: skids, nukes, exploits, or servers designed to cause harm.
  • Sharing or reselling your account access is strictly prohibited. If you wish to grant access to others, please contact support for proper configuration.
  • You may not misuse any other BOTs or services hosted on your server unless explicit permission is granted by the server owner.
  • Our services may not be used for illegal activities, including but not limited to hacking, phishing, or distributing malware. Violation of this rule will result in immediate termination of your account.
  • Any attempt to bypass security measures or abuse the infrastructure of ClutchVPS will result in immediate account termination without refund.

2. Security

We take the security of your data seriously, but your security is a shared responsibility:

  • We will not share your files with third parties unless explicitly authorized by you.
  • You may grant others permission to manage your server. We can assist with setting up shared management accounts for trusted users.
  • Your account token and credentials must be stored securely. We will never request your password or token, and it is your responsibility to keep these details safe.
  • SSL encryption is used for secure data transmission, including file transfers via SFTP.
  • Avoid granting destructive or excessive permissions to third-party bots. A leaked token or password could result in a security breach.
  • We will conduct routine security checks but will never misuse or compromise your servers or bot accounts. If your account is compromised, immediately contact our support team for assistance.

3. Purchase Terms

By purchasing services from ClutchVPS, you agree to the following terms regarding payment and refunds:

  • If you are under the legal age of majority, you must obtain consent from a parent or legal guardian to purchase our services.
  • Refund requests are accepted within 7 days of purchase, under the following conditions:
    • Refunds will be processed less any used resources (e.g., bandwidth, CPU, storage) during the period of usage.
    • Refunds will not be granted for violations of these Terms of Service.
  • Chargebacks or disputes filed without prior communication with our support team will result in immediate account suspension and a permanent ban from our services.

4. Fair Usage Policy

To ensure a stable and reliable service for all users, we maintain a fair usage policy:

  • We reserve the right to limit excessive use of system resources to ensure fair distribution of resources among all users.
  • Excessive use of CPU, RAM, or bandwidth may result in service suspension or downgrades, depending on the severity.
  • Automated scripts or bots that consume system resources without approval are prohibited.

5. Account Termination

ClutchVPS reserves the right to terminate or suspend accounts that violate these Terms of Service:

  • Accounts found in violation of our terms may be terminated without prior notice. No refund will be issued in case of termination for violations.
  • Repeated or severe violations may lead to permanent suspension and an IP ban from our services.
  • If suspicious activity is detected, your account may be temporarily suspended for investigation. If you believe the suspension was a mistake, please contact support for clarification.
  • Appeals may be considered in some cases. Please reach out to our support team for assistance in such matters.

6. Data and Backups

It is your responsibility to ensure that your data is properly backed up:

  • We do not guarantee automatic backups of your data. You are responsible for creating and storing your own backups.
  • ClutchVPS is not liable for any data loss resulting from server failure, account termination, or accidental deletion.
  • Some services may offer scheduled backups, but these should not be considered a primary backup solution. It is advisable to regularly backup your data.

7. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. It is your responsibility to review these terms periodically:

  • Continued use of our services after any changes to the terms constitutes your acceptance of those changes.
